Yankwitt LLP Achieves Favorable Resolution in High-Exposure Case for a Fraction of the Plaintiff’s Seven-Figure Demand

A Yankwitt LLP team led by Counsel Cassandra Vogel helped secure a highly favorable pre-trial resolution in a high-exposure premises liability case involving a plaintiff’s multi-million-dollar demand. With Yankwitt LLP’s assistance, the case settled for a fraction of the amount sought.
Yankwitt LLP was retained as independent, advisory counsel to two defendants – an LLC and its sole member – to bolster insurance-appointed counsel. The firm frequently plays this strategic role in high exposure litigation, particularly where there is a risk of insurance coverage gaps, denial of liability coverage, or other potential insurance coverage issues.
The case involved a plaintiff who was paralyzed after an alleged fall on the exterior stairs at the defendants’ property. She sued both the LLC that owned the house and its individual member.
Throughout the case, Yankwitt LLP provided strategic advice, including suggesting a change of venue, and critical feedback on all written legal submissions. In particular, Yankwitt LLP provided feedback on a summary judgment motion that the court granted as to the individual defendant, a pivotal victory that eliminated personal liability risk.
Yankwitt LLP also provided feedback on an appeal of the decision denying summary judgment as to the LLC, after which the plaintiff agreed to a settlement for a significantly reduced amount—far below the initial seven-figure demand.
