Yankwitt LLP Resolves Complex Business Dispute Filed in Westchester Supreme Court Commercial Division Between Contractor and Former Employee Who Asserted Partnership Interest

Yankwitt LLP represented the owner of a roofing company and his company in a dispute and subsequent litigation with an employee who asserted a partnership interest in the company after he was terminated for cause. The firm engaged in pre-litigation negotiations with the plaintiff’s counsel, which were unsuccessful and resulted in both the defendant and the plaintiff filing lawsuits against each other. In addition to the employment and alleged partnership issues, the defendant and the plaintiff had other business dealings, including joint ownership of several rental properties that required untangling. In the litigation, Yankwitt LLP successfully consolidated the two cases in the New York State Court’s Commercial Division in Westchester County and took an aggressive approach in discovery. As a result, the former employee agreed to a fraction of his original demand, and the parties ultimately entered into a global settlement by which Yankwitt LLP extracted its client from all of his business dealings with this former employee.
