Yankwitt LLP Secures Life-Changing Sentencing Outcome for Client in Federal Drug Case

A litigation team led by Yankwitt LLP Partner Jason Swergold, co-head of the firm’s Criminal Defense & Investigations Practice and a former Assistant US Attorney, achieved an outstanding outcome in a criminal matter for the firm’s client in the Southern District of New York: a sentence of time served and minimal supervision, replacing what could have been a years-long prison term.
In March 2024, while on federal probation for a prior drug conviction, the client was arrested after amphetamine packages were intercepted en route to his home. Facing serious new charges and a potential probation revocation, he retained Yankwitt LLP
Jason quickly reframed the case around our client’s untreated addiction. He presented evidence showing the drugs were for personal use, not distribution, and built a treatment-focused strategy. After months of advocacy,
Jason persuaded prosecutors to agree to bail and treatment over incarceration. He ultimately secured a misdemeanor plea and the government’s support for a time-served sentence.
Throughout, Jason remained closely involved in our client’s recovery, helping coordinate treatment and monitoring his progress. In June 2025, Judge Cathy Seibel sentenced our client to time served with one year of supervised release.
