Yankwitt Partner Jason Swergold Provides Insight into the Suppression Hearings in the Mangione Case

Yankwitt LLP Partner Jason Swergold was recently interviewed for an article in the Gothamist about this week’s high-profile suppression hearings in New York state court involving defendant Luigi Mangione, the man accused of killing the UnitedHealthcare CEO Brian Thompson. Drawing on his experience as a former Assistant United States Attorney in the Southern District of New York, Jason explained why the defense faces a difficult path as it seeks to exclude items taken from Mangione’s backpack during his arrest.
Jason noted that convincing a judge to suppress items recovered in the backpack will be an uphill battle.
The hearings center on whether police unlawfully questioned Mangione and searched his belongings at a Pennsylvania McDonalds last year. Defense lawyers argue that officers waited too long to advise Mangione of his Miranda rights and lacked proper authorization to examine his backpack, which contained a firearm, electronics and a notebook that prosecutors say ties him to the killing.
