Million Air and Westchester County Settle Three-Year Long Breach of Contract Lawsuit

Stipulation of Settlement filed for one of the largest cases in Westchester County.

White Plains, NY (December 3, 2024)— Yankwitt LLP is pleased to report that its client Million Air and Westchester County have settled their 3 ½-year long, $30-plus million lawsuit filed in June of 2021 after the county refused to allow Million Air to construct a replacement hangar at Westchester County Airport. Million Air alleged that the county’s actions breached the terms of its lease, which led to the filing of one of the largest cases in Westchester County.

The parties agreed to settle the matter with the filing of a Stipulation of Settlement on December 2, 2024, dismissing four out of five counterclaims with prejudice and discontinuing the remainder of this action, including Million Air’s claims in the amended complaint and the county’s fourth counterclaim, without prejudice.

According to the stipulation filed, the parties agreed to address in good faith two issues: 1) how Million Air will accommodate light general aviation aircraft along with heavy general aviation aircraft following the completion of the proposed new hangar, and 2) how the proposed new hangar will affect the number of repositioning or “ferry” flights from Million Air’s airbase. 

According to Million Air, the new proposed hangar will not only accommodate larger aircraft, but it will also provide ample space for light general aviation aircraft, and at a lower cost for owners of the smaller planes.  The proposed new hangar will also significantly reduce ferry flights given the increased capacity to hangar all types of aircraft.  

“Once these two issues are resolved, Million Air is hopeful that the parties will agree and they can build a second hangar without having to resort to refiling this action,” added Yankwitt.
