After successfully moving for summary judgment before the trial court, Yankwitt LLP has – successfully opposed the plaintiff’s appeal of the lower court’s decision, securing a complete victory for its casino client.
In the underlying case, the plaintiff, a self-proclaimed advantage card player and serial litigant, asserted numerous claims against Yankwitt LLP’s client following his eviction from the casino. The plaintiff had repeatedly attempted to play blackjack at reserved tables, harassed other patrons, and became combative when he was directed to leave the premises, resulting in the issuance of criminal charges against him. Yankwitt LLP moved for summary judgment following the close of discovery and the trial court issued a decision in the casino’s favor dismissing all claims.
After the plaintiff appealed, Yankwitt LLP submitted a thoroughly researched and persuasively written opposition brief demonstrating that none of the plaintiff’s claims were meritorious. In a lengthy decision, the New Jersey Superior Court, Appellate Division agreed with Yankwitt LLP on all appellate issues and affirmed the dismissal of the complaint in its entirety.
