Yankwitt LLP prevailed on behalf of a global advertising agency based in New York City in a wage and hour case venued in the United States District Court for the Southern District of New York. The case involves allegations of unpaid overtime by a domestic employer and also by the advertising agency where he works. Yankwitt LLP moved to dismiss the claims against the agency, arguing that it was not the plaintiffs’ employer for purposes of the Fair Labor Standards Act or the New York Labor Law. In a comprehensive, 22-page decision, the court agreed with Yankwitt LLP’s arguments and dismissed plaintiffs’ claims against the agency with prejudice.
