Yankwitt LLP Scores Complete Victory in Assault Case Brought Against a Prominent Businessman as Administrator of His Son’s Estate
Yankwitt LLP obtained a complete victory in a case brought against the CEO of a well-known international liquor company in his capacity as the administrator of his deceased son’s estate. The plaintiff, an acquaintance of the decedent, claimed that prior to his death, the decedent assaulted him, and, as such, the plaintiff sought $15 million in damages from the decedent’s estate.
Yankwitt LLP’s early assessment of the facts revealed that this was a frivolous lawsuit filed in an attempt to exploit a wealthy businessman. Through a focused strategy of aggressive discovery and a barrage of motion practice, Yankwitt LLP attorneys uncovered additional facts demonstrating that the plaintiff’s case completely lacked factual support. When we informed the plaintiff’s counsel about these revelations and warned that we would pursue sanctions if the plaintiff continued with his case, they immediately sought permission from the court to withdraw as the plaintiff’s counsel. Yankwitt then filed an early motion for summary judgment on the basis that there was no evidence that the plaintiff could introduce at trial to support his case.
The court granted our motion for summary judgment in its entirety, dismissing the case and vindicating our client without having to undergo the emotional and financial toll of depositions.
