Yankwitt LLP Wins Motion to Compel Arbitration in Employment Suit Against Regeneron Pharmaceuticals

A Yankwitt LLP litigation team led by partner Michael Reed successfully obtained an order compelling arbitration and staying litigation proceedings in a six-figure employment suit filed against global biotech company Regeneron Pharmaceuticals in New York State Supreme Court, Westchester County.

The plaintiff, who appeared pro se, alleged breach of contract, disability discrimination, and discrimination based on sexual orientation and sought more than $350,000 in damages.

At the outset of the case, the firm identified a threshold issue that proved dispositive: the plaintiff had signed a binding arbitration agreement with the staffing agency that recruited her. Under that agreement, employment-related disputes were to be resolved through arbitration, not in court.

Yankwitt LLP promptly filed a motion to compel arbitration while addressing multiple procedural filings submitted by the pro se plaintiff. On review of Yankwitt LLP’s motion, the court agreed that the arbitration agreement controlled and granted the motion to compel arbitration, and stayed the litigation pending the outcome of the arbitration proceedings.
