Yankwitt LLP Wins Summary Judgment Motion in Personal Injury Case Filed Against National Hospitality Company

Yankwitt LLP successfully moved for summary judgment to dismiss all claims against its client, a national hospitality company, in a personal injury action brought in New Jersey Superior Court. The plaintiff alleged that she tripped on a section of carpet that was folded over as she was exiting an elevator and sued the defendant for negligence. The plaintiff, however, failed to proffer any evidence to establish that a dangerous condition existed. She also testified at her deposition that she did not see anything that would have caused her fall, much less a dangerous condition that might have caused it. On January 27, 2020, the Court granted Yankwitt LLP’s motion for summary judgment in its entirety, finding that the plaintiff had not satisfied her burden of establishing the existence of a dangerous condition and that her negligence claims must be dismissed.
