Yankwitt LLP’s Compelling Advocacy Convinces Adversary to Drop All Claims Against Restaurant Client
Yankwitt LLP successfully persuaded its adversary to dismiss voluntarily its indemnification and breach of contract claims against our client, a New York City restaurant. The matter arose after the restaurant’s employee fell off of a ledge and sustained injuries, for which he received workers’ compensation benefits through the restaurant’s insurance carrier. The employee then sued the restaurant’s landlord, who in turn brought third-party indemnification and contract claims against our client. Yankwitt LLP articulated a powerful argument as to why the third-party claims were frivolous and failed as a matter of law. In advance of incurring costs for depositions, the opposing party surrendered and agreed to dismiss all claims against our client with prejudice – a victory that saved the restaurant from potential considerable exposure and significant legal fees.
