The Yankwitt Report: Firm News Worth Sharing

As New York moves beyond the spring shutdown, Yankwitt LLP is working at full throttle to protect our clients’ interests. And even though times are tough, we have had momentous occasions to celebrate, including the firm’s 11th anniversary this past July, officially starting our second decade of serving clients throughout New York, which we do zealously every day. An Award-Winning Year

Yankwitt LLP is proud to be recognized for its dedication to its clients, the legal profession, and the Westchester community. Six Yankwitt LLP attorneys were named to Super Lawyers and Rising Stars, and Managing Partner Russell Yankwitt was named to Best Lawyers in America® in commercial litigation, was honored by the Westchester County Business Journal as a 2020 C-Suite Award winner and was named an Elite Boutique Trailblazer by the National Law Journal.

Zoom Mediations Yield Positive Results and Happy, Satisfied Clients

With the courts closed down in the spring and re-opening at a measured pace, Yankwitt LLP has continued to successfully advance its cases using mediations conducted via Zoom. Here are four standout matters with outstanding results.

  • Yankwitt LLP represented a Los Angeles-based global entertainment company in a cyber breach case filed against an accounting firm. Our aggressive complaint followed by our assertive mediation statement and negotiating efforts led to a favorable monetary settlement for our client without the need for litigation.
  • Yankwitt LLP represented directors of a senior housing facility in a suit filed by the plan administrator and approximately 100 former residents alleging breach of fiduciary duty and financial disclosure obligation. The demand was $50 million, but we were able to settle the case for a fraction of that, fully paid by the insurance company and with releases for our clients.
  • Yankwitt LLP represented a Fortune 500 company in a product liability suit with a demand of $5 million. The mediation resulted in a settlement, of which our client paid less 5% of the demand.
  • Yankwitt LLP represented a foreign nonprofit organization in affirmative litigation against the company’s former law firm, asserting claims for excessive billing in prior litigations. At the mediation, the law firm agreed to reimburse a significant portion of the legal fees.

Leading the Way with Thought Leadership

Yankwitt LLP attorneys have been writing more than briefs. When the pandemic hit in March and Governor Cuomo put New York state on pause, the firm published a series of articles titled, “Proactive Through the Pause,”  focused on topics to help small businesses emerge from the COVID-19 shutdown stronger than ever. Additionally, Russell Yankwitt and Dina Hamerman wrote a Law360 article, “How NY Businesses Should Approach COVID-19 Waivers,” and the Westchester County Business Journal published an article by Russell and Alicia Tallbe, “Covid-19: The catalyst to the tidal wave of commercial lease litigation.”
