Yankwitt LLP Gets Subpoena Quashed in Matrimonial-Related Action
Yankwitt LLP successfully quashed a New Jersey subpoena arising out of a divorce action venued in Westchester County Supreme Court on behalf of the wife who was represented by a prominent Westchester County-based matrimonial lawyer. The husband was seeking to depose his wife’s elderly parents claiming his wife was using matrimonial assets for her parents’ home.
Yankwitt LLP filed a motion to quash the subpoena to depose the parents, claiming the questioning would be duplicative, harassing, and unnecessary. The court held that absent a stronger showing by the ex-husband, the depositions of the parents could not proceed.
Yankwitt LLP is often retained as litigation counsel by matrimonial, trusts and estates, bankruptcy and other law firms throughout New York that require aggressive litigators and trial attorneys.
