Yankwitt LLP Gets Subpoena Quashed in Matrimonial-Related Action

Yankwitt LLP successfully quashed a New Jersey subpoena arising out of a divorce action venued in Westchester County Supreme Court on behalf of the wife who was represented by a prominent Westchester County-based matrimonial lawyer. The husband was seeking to depose his wife’s elderly parents claiming his wife was using matrimonial assets for her parents’ home.

Yankwitt LLP filed a motion to quash the subpoena to depose the parents, claiming the questioning would be duplicative, harassing, and unnecessary. The court held that absent a stronger showing by the ex-husband, the depositions of the parents could not proceed.
